Terms of Service

Funded Group ("Funded Group," "we," "us") Effective date: October 7, 2026 | Last updated: October 7, 2026 Contact: Chris@fundedgroup.com By subscribing to or using the Funded Group website and lead service (the "Service"), you ("Customer") agree to these Terms and to our Privacy Policy.

1. The Service

We build and host a website for your local home-service business, with a page for each service and city you serve. We also provide lead tools: quote form, email and app lead alerts, customer confirmation email, estimate follow-up emails, review request emails, website chat, and a monthly email report. Features may change over time. The Service is delivered by email and app notification. It does not include text-message marketing.

2. Eligibility and accounts

You must be a business owner or authorized representative, at least 18 years old, with authority to bind your business. You are responsible for your login, for what happens in your account, and for keeping your contact and billing information current.

3. Price, billing, and cancellation

Price: $297 per month plus a 3.5% card processing fee at checkout (currently $307.40 total per month). Taxes may apply.
No setup fee. No long-term contract. The subscription renews monthly until cancelled.
Billing: your payment method is charged on the same day each month. You authorize recurring charges.
Cancel anytime by emailing Chris@fundedgroup.com before your next billing date. Cancellation takes effect at the end of the current paid month. Fees already paid are non-refundable, and we do not prorate partial months, except where required by law.
Failed payments: we may retry the charge and may suspend the Service if payment is not received. Your site may be taken offline during suspension.
Price changes: we will give at least 30 days' email notice before changing the price.

4. Delivery timeline

We target delivery of your initial site within 2 business days of receiving your completed intake form and first payment. Timelines depend on you providing accurate and complete information, photos, and approvals. Delivery times are estimates, not guarantees.

5. Your responsibilities and content

You must give us accurate, lawful information. You are responsible for the accuracy of everything on your site, including license numbers, insurance claims, years in business, service areas, hours, reviews, prices, and photos. You confirm that you have the right to use all logos, images, and reviews you provide. Do not ask us to publish false or misleading claims, fake reviews, claims you cannot support, or content that is unlawful, infringing, defamatory, or deceptive. We may refuse or remove content, or suspend the Service, if it breaks these rules or advertising, platform, or other laws. You must review your site before and after launch and tell us promptly about errors.

6. Use of artificial intelligence

We use AI tools to help create site text, titles, descriptions, and other content. AI output may contain mistakes or may resemble other content. Our team reviews your site before delivery, but you are responsible for confirming that the final content is accurate, lawful, and does not mislead customers. You agree not to rely on the Service for legal, licensing, or compliance advice. If your site includes an AI chat assistant, you agree we may disclose to visitors that they are chatting with an automated assistant.

7. Leads, communications, and compliance

Leads and chat messages submitted through your site belong to your business. We store and process them for you.
You are responsible for how you contact leads, including compliance with email laws (CAN-SPAM), telemarketing and do-not-call rules, and state laws. Our automated follow-up is email-based.
Your site will include a Privacy Policy and Terms of Service. You are responsible for reviewing them and for any additional notices your business needs. We do not provide legal advice.
Do not use the Service to send spam, to contact people who have asked not to be contacted, or to collect sensitive information (financial accounts, Social Security numbers, health information).

8. Included edits and support

Your plan includes up to 2 small website edits per month (text, hours, photos, adding or removing a service or city). Larger changes, redesigns, custom features, and extra pages are quoted separately. Unused edits do not roll over. Support is by email at Chris@fundedgroup.com.

9. Hosting, domain, and ownership

Your site is hosted on our platform while your subscription is active. If you cancel, your site and lead tools go offline at the end of the paid period.
Your content (logo, photos, business information, reviews, leads) stays yours. On request within 30 days after cancellation, we will give you an export of your leads and your submitted content.
The site design, code, templates, workflows, and tools are owned by Funded Group or its licensors. You receive a non-exclusive license to use them during your subscription. They are not transferred to you and cannot be copied to another host.
If you bring your own domain, you remain the domain owner. We will help point it to the site and will remove our settings when you cancel.

10. No guarantees

We provide a professional website and lead tools. We do not guarantee search rankings, website traffic, number of leads, jobs, revenue, or review volume. Results depend on your market, reputation, pricing, responsiveness, and many other factors outside our control. The Service is provided "as is" and "as available," and we disclaim all warranties to the fullest extent allowed by law, including merchantability, fitness for a particular purpose, and non-infringement.

11. Third-party services

The Service relies on third parties such as GoHighLevel, Stripe, Cloudflare, Google, and Meta. Their outages, policy changes, or terms may affect the Service, and we are not liable for them. Your use of Google Business Profile, Google reviews, and ad platforms is governed by their terms.

12. Acceptable use and suspension

We may suspend or end the Service immediately if you violate these Terms, the law, or a platform's rules, if we receive a credible complaint about your content, or if your use puts the platform or other customers at risk.

13. Limitation of liability

To the fullest extent allowed by law: (a) Funded Group is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost leads, lost data, or lost business; and (b) our total liability for any claim relating to the Service is limited to the fees you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to defend and indemnify Funded Group against claims, losses, and costs (including reasonable attorney fees) arising from your content, your business practices, your violation of these Terms or the law, or your contact with leads.

15. Privacy

Our Privacy Policy describes how we handle personal information, including AI, advertising tools, and data requests. Where we process personal information on your behalf (your leads), we will use it only to provide the Service to you, will keep it confidential, will use appropriate security, will help you respond to individual requests, and will delete or return it when the Service ends (see Section 9). You are responsible for providing any notices and getting any consents your business needs.

16. Changes to these Terms

We may update these Terms. We will email you at least 30 days before material changes take effect. Continuing to use the Service after the change means you accept it. If you disagree, you can cancel before the change takes effect.

17. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Minnesota, and you consent to that jurisdiction. Before filing a claim, you agree to contact us at Chris@fundedgroup.com and try to resolve the dispute informally for 30 days.

18. General

These Terms and the Privacy Policy are the entire agreement between us. If a part is unenforceable, the rest remains in effect. You may not assign these Terms without our consent. We may assign them in a merger or sale. Our failure to enforce a right is not a waiver. Notices to you will be sent to your account email.
